Agreement to Terms
Welcome to Loma de Atitlán. These Terms of Service ("Terms") form a legally binding agreement between you and Lomas de Tzununa, S.A., a company organized under the laws of the Republic of Guatemala and operating the wellness sanctuary known as Loma de Atitlán in Tzununa, Sololá, Guatemala ("we," "us," "our"). The Terms govern your access to and use of lomadeatitlan.com, our guest portal, our booking and payment services, and your stay at our sanctuary. By accessing the website, creating an account, making a reservation, or staying with us, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our website or services.
Reservations and Bookings
Booking Confirmation
All reservations are subject to availability and confirmation. We reserve the right to refuse any reservation at our discretion. A confirmation email will be sent upon successful booking.
Payment
Full or partial payment may be required at the time of booking. We accept major credit cards and other payment methods as specified during the booking process. All prices are subject to change without notice.
Minimum Age
Guests must be at least 18 years of age to make a reservation and check in to the resort.
Check-in and Check-out
Check-in: 3:00 PM
Check-out: 11:00 AM
Early check-in and late check-out may be available upon request and subject to availability. Additional charges may apply.
Cancellation and Refund Policy
Cancellations must be made at least 7 days prior to the scheduled arrival date to receive a full refund. Cancellations made within 7 days of arrival will be charged the full reservation amount.
In case of early departure, no refunds will be issued for unused nights.
Special rates, packages, and group bookings may have different cancellation policies, which will be communicated at the time of booking.
Guest Responsibilities
Guests agree to:
- Respect the property, staff, and other guests
- Comply with all resort policies and local laws
- Be responsible for any damage to the property during their stay
- Not engage in illegal activities on the premises
- Respect quiet hours (typically 10:00 PM - 7:00 AM)
- Not smoke in designated non-smoking areas
- Supervise any children at all times
Acceptable Use of Our Website and Services
When you use our website, guest portal, mobile applications, or APIs, you agree that you will not:
- Use our services for any unlawful, fraudulent, deceptive, or malicious purpose
- Access, scrape, copy, mirror, or harvest content from the site by automated means without our prior written consent
- Attempt to gain unauthorized access to any account, computer system, network, or data, or interfere with our security measures
- Upload or transmit viruses, malware, or any code designed to disrupt, damage, or surveil our systems or other users
- Submit false, misleading, or third-party personal information through any form or booking flow
- Reverse engineer, decompile, or attempt to extract source code from any part of our services
- Use our brand, logo, photography, or content for advertising, resale, or derivative works without prior written permission
- Bypass rate limits, geo-restrictions, or other technical controls we put in place to protect the service
- Harass, abuse, or threaten our staff, guests, or community members through any communication channel we operate
Guest Portal Accounts
Some features (community feed, retreat planner, my-stay portal) require a guest portal account. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must notify us immediately at info@lomadeatitlan.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, that we reasonably believe are compromised, or that are used to abuse our services or staff.
Limitation of Liability
Loma de Atitlán shall not be liable for any loss, damage, or injury to persons or property during your stay, except in cases of gross negligence or willful misconduct. Guests are responsible for their personal belongings and should use the safe deposit boxes provided.
Force Majeure
We shall not be held liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, wars, civil unrest, or pandemics.
Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.
Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Loma de Atitlán and is protected by copyright and other intellectual property laws. Unauthorized use is prohibited.
Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Guatemala. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Guatemala.
